Multiple Federal "Red Flag" Bills Introduced in Congress!

Senator Marco Rubio (R-FL) introduced the Extreme Risk Protection Order and Violence Prevention Act of 2021 (S.292). U.S. Senators Tim Kaine (D-VA) and Mark Warner (D-VA) also introduced federal gun control legislation seeking to create federal “red flag” standards for firearms confiscation. The Virginia Plan to Reduce Gun Violence Act of 2021 (S.1155) would expand background checks, limit handgun purchases, and enact red flag laws at a national level. And now, Senator Diane Feinstein (D-CA) has introduced the Extreme Risk Protection Order Act (S.1819) as well.

This is in addition to H.R. 2377, sponsored by Lucy McBath, which was voted out of the House Judiciary Committee on October 27, 2021, by a vote of 24-18. This bill would create new federal law for “Extreme Risk Protection Orders” that allows for a person to petition a federal court to confiscate firearms, ammunition, and permits in an ex parte process.
