GEORGIA 2020 ELECTION AUDIT PETITION
 
WHEREAS, to have a legitimate, trustworthy, and Constitutional electoral process Georgians must be able to determine the root causes of known problems identified in the November 3, 2020 and January 5, 2021 elections so that solutions can be implemented in time for the 2022 elections

WHEREAS, four senior poll managers and two audit monitors submitted sworn affidavits under penalty of perjury stating they saw counterfeit ballots in the Fulton County hand count audit conducted November 14-15, 2020

WHEREAS, Fulton County mail-in ballots have still not been publicly inspected for counterfeits which may number into the tens of thousands according to at least one of the affidavits

WHEREAS, a recent order to dismiss the Fulton County ballot inspection case leaves Georgia voters with no recourse to protect their voting rights against ballot stuffing

WHEREAS, the recent order to dismiss the case is in direct conflict with U.S. Supreme Court precedents that have already found the right to vote cannot be diluted by ballot box stuffing

WHEREAS, an appeal to reverse the dismissal of the Fulton County ballot inspection case will not be resolved in time to identify problems and provide relief for Georgia voters in 2022

WHEREAS, Georgia’s Dominion Ballot Marking Device (BMD) output is unverifiable to the voter because the voter’s ballot summary encodes votes in a Quick Response (QR) barcode that the voter cannot read or verify to ensure they match the printed text in the summary

WHEREAS, a U.S. District Court judge ruled that Georgia’s Dominion BMD voting system violates two election statutes requiring the system to produce an elector verifiable ballot with human readable text (Order, pp. 81-82)

WHEREAS, Georgia’s Dominion BMD voting system tabulators malfunctioned in multiple counties during the November 2020 election and thus impacted thousands of votes cast

WHEREAS, no forensic evaluation has been performed to determine the root cause and impact of these malfunctions

WHEREAS, components of the same Dominion BMD voting system that Georgia uses were rejected in Texas and banned in Colorado before the Georgia Secretary of State purchased it

WHEREAS, massive errors and fraud were found in the Fulton County November 2020 presidential race audit including a 60% batch error rate, falsified tally sheets and thousands of duplicate votes reported in the audit

WHEREAS, the errors and fraud found in that audit make it impossible for the audit results to have been used to verify the published election results

WHEREAS , dozens of Georgia counties have already destroyed original ballot images and other election records for the November 2020 election, making it impossible to obtain those images to audit their election results

WHEREAS, an Arizona audit of the November 2020 election results found as many as 50,000 invalid ballots that diluted legitimate votes

BE IT RESOLVED, that we the undersigned demand the Governor instruct the legislature to evaluate public concerns about November 2020 election integrity problems to restore public trust in Georgia elections; and

BE IT RESOLVED, that we the undersigned demand our legislators to conduct a multi-county forensic audit of ballots, election server images and voter eligibility using subpoena powers granted their committees (O.C.G.A. § 28-1-16) as necessary to resolve known outstanding election integrity problems prior to the 2022 elections.
