Many changes were made in the election law this past legislative session through SB 180 Election Changes (Chapter 39). While some of the changes are good, several are genuinely concerning. As they consider rules for implementation, we need your help to point out the problem areas.
The change noted in 1.10.22.10 was the removal of "absentee by mail" and it now reads "mailed ballot." By not calling them absentee ballots, it moves people closer to accepting mailed ballots as a normal practice for future all-mail elections.
The main change in rules for provisional voting is in 1.10.22.11. This rule coincides with 1-12-25.2 NMSA 2023. Provisional Voter Notification and Hearing Process. They added the right to appeal and to provide information or documentation to cure the ballot. You will have to submit a written request for a hearing to appeal the rejection of a provisional ballot.
Finally, changing the rule on hearing officers would provide a better chance for a non-biased decision since the clerk’s staff would not be considered neutral in this matter. Please read the rule in its entirety and add it to the comment as you see fit.
