Oppose Wage Theft Allegation Bills

If you operate a restaurant or nightlife establishment in New York you NEED to contact your state elected officials ASAP and tell them you strongly oppose A486/S2844, which would allow employees to file personal liens against business owners solely upon the allegation of a wage dispute, allow the state to place liens on property on behalf of claimants and make shareholders in limited liability companies personally liable for wage claims.

While we take wage theft extremely seriously – and recognize the proposal’s positive intentions – the bill as drafted would have devastating consequences on small businesses and employment in New York State.

Take a minute and send a pre-written letter and/or add in your personal story for a more effective letter.

*** VERY IMPORTANT:  Make sure to send a separate email for each NYC restaurant and/or nightlife venue you operate. Enter each business address separately so all of your elected representatives hear your voice. The more businesses they hear from, the more powerful the message is!

WHAT WOULD A486/S2844 DO?

  • Allow any disgruntled employee to file a lien on their current or former employer and its owners based on the employee’s mere allegations of wage violation
  • Freeze credit on small businesses, because when a lien is filed banks won’t extend credit
  • And, even put first-line managers and other individuals at risk of financial ruin because such individuals are “employers” under state and federal law and employees could assert liens on their assets.
