Stop the ATF's Arbitrary Interpretation of the NFA
The Firearms Regulatory Accountability Coalition, Inc., (FRAC) government affairs team in Washington, D.C., will begin working with U.S. policymakers to urge the Department of Justice (DOJ) to take action on recent actions by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) in classifying firearms like the Honey Badger pistol as a short-barreled rifle.
We are disappointed to learn the ATF has been allowed to continue to target small businesses and put millions of firearms owners in danger of federal prosecution.
We strongly disagree with this arbitrary, inequitable, and poorly advised determination which was carried out in a completely non-transparent and hostile manner.
In the past decade, the ATF has repeatedly found that firearms with pistol stabilizing braces, like the one equipped on Q’s Honey Badger pistol, are not “designed and intended to be fired from the shoulder,” and are therefore not subject to regulation under the NFA.
Without proper procedures in place by the ATF, the public and industry stakeholders have been left in the dark without any notice or opportunity to provide substantive feedback. FRAC and its member companies and stakeholder partners strongly recommend that the ATF implement a transparent process like the majority of agencies in Washington. It’s time for the ATF to adhere to processes that other major U.S. agencies routinely follow to better serve its stakeholders.
We recommend the creation and implementation of a clear set of rules that law-abiding gun owners and manufactures can reasonably follow. The current arbitrary approach is clearly inconsistent with the right to keep and bear arms and due process of law.
Please take action by contacting the Department of Justice and Congress and urge them to take swift action to reign in ATF and reverse this terrible determination that will impact others in the industry and stifle innovation and put Americans in legal peril.
