The Safe Step Act (H.R. 2630/S. 652) would:
- Require Insurers to implement a clear and transparent process for a patient or physician to request an exemption for a step therapy protocol
- Mandate insurers respond to a step therapy exemption request within 72 hours and 24 hours if the patient’s life is at risk
- Outline 5 exceptions to step therapy protocols:
- Patient has already tried and failed on the required drug
- Delayed treatment will cause irreversible consequences for the patient
- Required drug will cause an adverse reaction to patient
- Required drug will prevent the patient from fulfilling activities required for daily life, including working
- Patient is stable on current medication selected by their provider
