Two measures to ensure better air quality decisions!

Resolution R-23-176, states the board must follow the Air Quality Control Act and cannot broadly consider other objections when creating regulations. It provides a moratorium that prevents the City from using resources to facilitate actions by the current board to make, adopt, or amend any regulation or standard, that purports to address quality of life impacts without scientific evidence in violation of existing law.

The ordinance, O-23-88, repeals the current Air Quality Control Board ordinance and replaces it with a new one that establishes the Joint Albuquerque/Bernalillo County Air Quality Control Board. The purpose is to emphasize the board operates on behalf of the City and must abide by the laws of New Mexico. This has not always been the case.

The proposed ordinance establishes necessary safeguards to hold the board accountable and ensure it is comprised of diverse experts who can appropriately consider important matters relating to air quality in our community. It limits the scope of the board’s authority making clear it cannot create regulations not supported by scientific evidence or expand the definition of air pollution.
