But the reality is that the feds almost always reply on state and local resources to enforce their laws and regulations. By denying them this assistance -- like the left did when President Trump wanted to deport violent illegal aliens -- Biden’s war on gun owners will go largely unenforced. The Supreme Court has ruled for hundreds of years that the states can not be ‘commandeered’ or compelled into enforcing federal laws and regulations that they disagreed with. And of course the State of Ohio has that power; if not, we may as well dissolve the legislature entirely. That’s why, when Missouri passed this landmark legislation in 2021, it survived a court challenge by the Department of Justice. The other benefit to the SAPA legislation being pushed by Ohio Gun Owners and Rep. Loychik is the protection it provides for pro-gun cops who are trying to honor their oath of office and uphold the Second Amendment. So rather than be put in a spot where they have to break their oath or lose their job when told to enforce Biden’s gun control, an officer could simply point to SAPA as his defense. And should a liberal, politically appointed department head try to violate SAPA law, this legislation allows individual gun owners to sue those agencies (not the individual officer) in civil court. This is also part of the law in Missouri and without it, SAPA is nothing but a political gimmick. While dozens of states have passed Constitutional Carry over the last few years and while dozens of states are also following Missouri’s lead and advancing SAPA law this year, Ohio politicians are still talking about passing ‘Red Flag’ gun confiscation laws and other bogus gun control bills! I want to make sure you know that once the midterm elections are over, I expect to see quick action on bills like House Bill 62, the Second Amendment Preservation Act.
