The Violence Against Women Act (H.R. 1620) contains provisions that will actually harm women -- not to mention, hurt all Americans.
In particular, Sections 801 and 802 contains a Red Flag provision that has been misused and abused to target women.
Researcher David Kopel told Congress in 2019 that “about a third of gun confiscation orders are wrongly issued against innocent people.”
And Kopel referenced a police report where a concealed carrier in California was disarmed with a GCO by her cheating husband: “[The woman] began carrying her Glock handgun within her residence [but] a GVRO was obtained [by the husband] to confiscate the Glock handgun.”
This is unacceptable. Innocent people are harmed and killed when Due Process is thrown out the window. Even the liberal Rhode Island ACLU in 2018 questioned a Red Flag bill similar to the one in H.R. 1620:
“The court order … could be issued without any indication that the person poses an imminent threat … without any evidence that the person ever committed, or has even threatened to commit, an act of violence with a firearm … police would have broad authority to search the person’s property. The standard for … issuing an order is so broad it could routinely be used against people who engage in ‘overblown political rhetoric’ on social media ….”
