The VAWA is Full of Gun Control -- Oppose It!
The Violence Against Women Act (VAWA) that passed out of the House earlier this year (H.R. 1620) is full of gun control legislation, and with notorious gun-grabbers like Dianne Feinstein and Dick Durbin drafting the Senate version, I’m very concerned that this bill is going to become a major threat to my gun rights!
The House version of this legislation has at least four areas of gun control in it.
First, Section 1201/1202 of the bill requires that the FBI send an incident report to local law enforcement every time a gun owner fails a NICS check, setting the stage for a criminal investigation, even though 94% of NICS denials are false positives!
And while 6% of these denials are legitimate, the fact of the matter is that the feds simply don’t prosecute these. In 2010, 76,000 people were stopped by NICS. 44 of those were deemed prosecutable by the feds, and a mere 13 of those cases resulted in convictions. In 2017, the NICS system stopped 112,090 transactions. And after the false positives were subtracted, the government successfully prosecuted just 12 people!
That’s .0009% of the people flagged by NICS!
Clearly using the NICS system to spawn off criminal investigation is a total waste of time.
More than that, it will lead to gun owners being harassed for nothing!
Second, Section 801 of the bill would add stalking to the list of misdemeanors that would result in a lifetime gun ban. And while I’m not defending stalking, this is a disaster waiting to happen.
Felonies have long been the threshold for when someone is added to the ‘prohibited persons’ list. But if Republicans in Congress give in to Dianne Feinstein and agree to disarm gun owners for misdemeanor stalking, you’ll be opening Pandora’s Box. Over time, dozens of additional misdemeanors will be added to this list, resulting in millions of gun owners being disarmed.
Third, Section 1203 of the bill would allow the feds to deputize state/local prosecutors to serve as assistant United States Attorneys, and state/local police officers to serve as ATF agents, to aid in the prosecutions of violations of this legislation.
Let me be very clear, the LAST THING I want is to have Merrick Garland weaponize local law enforcement against gun owners. If a gun owner commits a crime, he should be prosecuted. But this is a nothing more than a partisan witch hunt by a tyrannical White House against gun owners.
Fourth, Section 801 of this bill would dramatically change the definition of which Americans could be prosecuted for domestic violence. H.R. 1620 specifies that sexual contact is NOT required for these cases and that a mere ‘social relationship’ with someone would leave you subject to this section.
This is absurd. If a co-worker doesn’t like me, could he file a domestic violence allegation against me? How about a liberal school board member who is mad that I’m opposing the CRT filth that is being taught to my kids in school? ‘Social relationships’ is deliberately written to be as broad as possible, to ensnare as many people as possible.
The impact of these four sections of the bill could result in MILLIONS of gun owners being disarmed over time. Of course, this is exactly what Joe Biden and your conference are trying to do. But the election results of the last few cycles -- especially in Virginia and New Jersey -- have made it clear that gun control is a losing issue for Democrats up and down the ballot.
That’s why I am emailing you today, to insist that you REFUSE to support the Violence Against Women Act until each of the four sections above are removed from the bill.
If your conference pushes this bill forward without removing these sections, you are only increasing the likelihood that your party will lose control of one or both chambers of Congress in November.
Georgia Gun Owners will keep me informed about the status of this bill.
Local Cops and Prosecutors Are Supposed to Enforce Local Laws!
Joe Biden and your conference are pushing the most radical gun control agenda that America has seen in decades, introducing gun control bills that would do irreparable damage to my right to keep and bear arms if passed into law.
But while Biden and Congressional Democrats would love to simply ban our AR-15’s or pass a national ‘Red Flag Gun Seizure’ law, you don’t have the 60 votes they need to get this done. In the meantime, your conference is working hard to pass the ‘Violence Against Women Act’ (VAWA) which is full of bureaucratic and administrative gun control.
One of most egregious sections of the House’s version of the VAWA (H.R. 1620) would allow the federal government to deputize local cops to act as temporary agents of the ATF, while deputizing local prosecutors to work as Assistant US Attorneys, with the goal of prosecuting violations of VAWA in federal court!
This is all a part of the radical left’s war on gun owners. Biden knows that his gun control agenda isn’t popular in ‘red’ America and that trying to get a jury to convict gun owners of the types of new ‘crimes’ detailed in the VAWA would likely be impossible. And that’s why they want these cases tried in federal court.
I don’t want local cops to be mere appendages of the corrupt ATF.
And I certainly don’t want our local prosecutors to become mere appendages of the Merrick Garland Department of InJustice!
Democrats at all levels of government are trying to force every man, woman, and child in the country to submit to their vision for America. And part of that vision includes disarming as many Americans as they possibly can, so that we’re unable to resist their tyrannical agenda.
Federalizing and weaponizing local authorities against gun owners is all part of that agenda.
That’s why I’m writing to urge you to ‘VOTE NO’ on the VAWA as it is currently written.
You may not want to oppose this legislation because of the gun control that is contained in it. But in light of the election results in Virginia and New Jersey last year, not to mention Joe Biden’s plummeting poll numbers, you certainly better think about opposing it due to the harm it will bring to your conference in November!
Georgia Gun Owners will keep me informed about the status of this bill.
Weaponizing NICS Against Gun Owners is Bad for Your Conference!
Radical leftists in the White House and your conference are determined to do anything and everything they can to harass law abiding gun owners like me.
The ‘Violence Against Women Act’ (VAWA) that passed out of the House (H.R. 1620) and that is being unveiled in the Senate by Dianne Feinstein and Dick Durbin -- aided by Republican backstabbers like Joni Ernst -- is just the latest example of this.
One key provision of this language is a requirement that the FBI send an incident report to local law enforcement any time a gun owner fails a NICS check, encouraging local authorities to open a criminal investigation.
But the NICS system is a joke, and an estimated 94% of NICS denials are false positives, meaning that tens of thousands of gun owners will be harassed for nothing if this language remains in the VAWA!
But that’s not all.
The VAWA would also weaponize local law enforcement by making local cops into ATF agents and local prosecutors into deputy US Attorneys to be able to prosecute violations of this bill.
VAWA also allows gun owners to be declared a ‘prohibited person’ and disarmed for life for a misdemeanor conviction of stalking. Of course, no one is defending stalking. But once we start designating misdemeanors as grounds for being declared a prohibited person, we are opening the flood gates and eventually we’ll see dozens of misdemeanors added to this list!
This could disarm a massive number of gun owners!
The VAWA also changes the definitions of who can be prosecuted under federal domestic violence statues by clarifying that ‘sexual contact’ is not required between the parties and that anyone in a ‘social relationship’ would meet these parameters. This standard is wide open for abuse.
I’m tired of the gun grabbers doing everything they can to demonize, threaten, and harass law abiding gun owners. That’s why I’m writing to urge you to ‘VOTE NO’ on the Violence Against Women Act until every single piece of gun control is removed from this bill!
