Like gun owners all across the county, I watched in disgust as Missouri residents Mark and Patricia McCloskey were indicted on felony charges for defending themselves against a violent mob who threatened them in 2020. But the truth is that until Idaho updates our Stand-Your-Ground law, any gun owner in our state could find themselves in a similar position. That’s why I am writing to you today, as a voter in your district, to urge you to co-sponsor the Stand-Your-Ground Expansion legislation that has been filed by Senator Christy Zito and the Idaho Second Amendment Alliance. This legislation would provide criminal immunity for gun owners who use justifiable and reasonable force against a violent predator. Naturally, if a person breaks the law and uses unjustifiable force, they should stand trial for it. But for Idahoans who are clearly defending themselves, we should not have to worry about being McCloskey’d just because a liberal prosecutor wants to advance a personal agenda. This legislation also provides a clear enactment clause, so gun owners can invoke this immunity BEFORE they are put through the misery of a criminal trial. After all, our Stand-Your-Ground laws don’t do much good if we can only invoke them upon appeal. At that point, my reputation has already been destroyed and I will likely be bankrupt from massive legal fees. Finally, this legislation clarifies that if I am found not guilty of a self-defense shooting, the state of Idaho (or the appropriate county agency that brought charges against me) will pay my legal fees. This is already the case in neighboring Washington, and we need it here in Idaho as well. As you can see, this legislation plugs the gaps in Idaho’s Stand-Your-Ground law and would give us one of the best self-defense laws in the county. Please co-sponsor this bill today.

Everyone knows that Idaho is in the midst of a massive demographic shift, as Californians, Washingtonians, and Oregonians move into our state in record numbers. It’s also no secret that some of these peoples are bringing a very liberal ideology along with them. That’s why I am urging you to co-sponsor Senator Christy Zito’s Stand-Your-Ground Expansion legislation which would plug the gaps in Idaho’s current self-defense laws. This legislation would provide criminal immunity to gun owners who use justifiable/reasonable force as well as establishing a pre-trial hearing process so that gun owners can assert their criminal immunity protections BEFORE their lives are turned upside down by a politically motived prosecution. Please make this one of your top priorities in 2022. Out state is changing, and there is no telling how long we will have a pro-gun majority in Boise. Gun owners across the country were stunned when Mark and Patricia McCloskey were indicted by a Soros-funded prosecutor in pro-gun Missouri in 2020. After all, they were clearly defending themselves from an out-of-control mob. But the truth is that until Idaho passes Senator Zitos’ legislation, gun owners right here in Idaho are vulnerable to the same sort of politically motivated prosecutions. But what was absolutely outrageous was the fact that the Soros-funded prosecutor was doing fundraising emails off the case while in the middle of it. This same prosecutor replaced a broken firing pin in Mrs. McCloskey’s handgun, just so she could charge Patricia McCloskey with additional ‘crimes.’ Thankfully, President Trump and the Governor of Missouri intervened and pardoned the McCloskeys. But here in Idaho, our self-defense laws have some of the exact same holes in them that could allow a ‘woke’ prosecutor to come after gun owners. That’s why, as a voter in your district, I am writing to urge you to co-sponsor the Stand-Your-Ground Expansion legislation that has been introduced by Senator Christy Zito. I understand your caucus may be opposed to this legislation, but it is very obvious that the American people, and especially Idahoans, do not support the radical left’s gun control agenda at all. So, you have a choice to make this session. Will you stand up for the rights of law-abiding Idahoans and their right to defend themselves and their loved ones against a violent criminal, or will you follow your party’s liberal talking points?
