Support HB 676 and Defend Firearm Preemption!
Idaho is one of 41 states with a firearm preemption law.
The law was designed to prevent cities and counties from enacting any forms of firearm regulations; meaning the state of Idaho is where those debates and laws would be handled.
The purpose of the firearm preemption law is to prevent a patchwork of firearm regulations that end up landing gun owners in jail because they travel from one city where firearms can be carried, and then travel to another city where they cannot but they are unaware of which cities have which laws.
The law really couldnāt be clearer, but, unfortunately, some liberal cities are violating the law in a way in which we never thought they would try and do, and thatās what HB 676 is designed to address.
In 2019, the city of Sandpoint violated our statesā firearm preemption law by temporarily āleasingā a public park to a private organization and that private organization then banned firearms in the PUBLIC park!
If the city of Sandpoint cannot regulate firearms in a public park, how can they possibly give a private organization that ability on that public property?
The ISAA and Second Amendment Foundation are currently suing the city on behalf of two citizens whose rights were violated. That lawsuit is currently being appealed to the Idaho Supreme Court.
While citizens eagerly await a decision from the ISC, I want you to ensure another liberal city doesnāt try and violate our rights like Sandpoint did.
If a city is going to temporarily lease public property to a private organization, that organization has to follow the same laws and recognize the same right to keep and bear arms in that space that the city or county must follow.
Firearm preemption law is quickly becoming the new battle in the right to keep and bear arms!
States like Washington, Oregon, and Colorado have all had heated battles over firearm preemption with gun control groups pushing to eliminate firearm preemption altogether.
Idaho must lead the way in strengthening firearm preemption, and I want you to support HB 676 to do just that!
