OPPOSE S2762 Wage Lien Bill
As a business operator in your district, I stand in firm OPPOSITION to the wage lien bill S2762 being considered in New York State Senate. I urge you to oppose this bill as it could be devastating to small businesses in New York State, especially as we try to recover from the devastation of the pandemic.
This bill would allow employees to file personal liens against small business owners, our investors, and even our frontline managers based solely upon the allegations of a wage dispute, not a judicial ruling or judgement.
That means, New York State is eliminating our due process rights and now a lien could hurt or freeze my personal credit, and that of my investors and frontline managers. It could also result in us being unable to sell assets like a home, a car, or even certain investment accounts.
I believe we must address wage theft in New York State, but this approach is unfair, unworkable and could cause significant damage to businesses like mine.
New York State should absolutely allocate the resources necessary to root out bad actors and enforce our wage theft laws. But please don’t put an entire industry and small business sector at risk with the overreaching language in S2762.
I once again urge you to reject these bills and thank you for your consideration.
