Representative Stephanie Borowicz is introducing the Second Amendment Preservation Act on behalf of gun owners like me! This bill will put an end to the enforcement of Federal gun tyranny here in Pennsylvania (like the ATF's pistol brace ban) by forbidding Pennsylvania law enforcement, all the way from the PSP to your County Sheriff, from enforcing Federal gun laws. It's very simple. Our cops should not be working with the Feds to enforce unconstitutional gun laws, executive orders, or bogus administrative rulings. And besides, the Federal government does not have the resources to enforce these gun laws and regulations on their own - that's why they need our LEOs to do their dirty work! SAPA has teeth, too. If an agency is working with a Federal Task Force in regards to any unconstitutional gun law or regulation, and takes action against a Pennsylvania gun owner, that gun owner has legal standing in court to sue the law enforcement agency for civil damages of up to $50,000 per officer hired by the department, per infraction! Thankfully, the Supreme Court has upheld the 'anti-commandeering' doctrine that Borowicz’ SAPA bill is based upon in prior rulings, so gun owners know this law is on solid legal footing. And this bill is not groundbreaking either, as this same bill was passed and became law in Missouri back in 2021. And I know it is good policy because 1. it has survived multiple court challenges, and 2. it is being VICIOUSLY pursued by Joe Biden & Merrick Garland's corrupt Department of Justice in federal court - unlike any other pro-Second Amendment bill in the country. And it is withstanding federal court scrutiny, too. That's why, as my State Representative in Harrisburg, I am urging you to co-sponsor Stephanie Borowicz's Second Amendment Preservation Act (SAPA) bill and go on OFFENSE for my gun rights this session! Holding the line on defense against Shapiro and Rozzi's gun control agenda is not going to be enough - the best defense is often a good OFFENSE! Representative Stephanie Borowicz is sponsoring the Second Amendment Preservation Act for all Pennsylvania gun owners! This bill is very simple: It requires Pennsylvania law enforcement agencies to enforce Pennsylvania’s gun laws, and prohibits those same agencies from enforcing unconstitutional federal gun laws, regulations, rulings, or executive orders. Under the 2nd & 10th Amendments to the U.S. Constitution, Article 1 Section 21 of the Pennsylvania Constitution, and numerous Supreme Court cases upholding the anti-commandeering doctrine - the law is on our side. And because the Feds do not have the resources or the manpower to enforce their own gun laws, this will effectively put an end to the enforcement of bad gun laws here in Pennsylvania, like the ATF’s recent unconstitutional pistol brace ruling! And by allowing any negatively affected Pennsylvanian to take a state or local law enforcement agency into civil court for damages, this bill has teeth, and is not dependent on the Commonwealth’s Attorney General for enforcement. This is needed now more than ever with the tyrannical ATF coming for millions of our firearms. Gun owners like me are sick and tired of being treated badly by Pennsylvania politicians. We get ostracized and vilified after every shooting and blamed for the sins of others, when we have no guild and share zero percent of the blame. And now that Governor Shapiro is seated in the Governor's mansion and Speaker Rozzi holds the gavel, our gun rights are once again under attack. The fact is, the next elections are never far away. And you best believe that gun owners like me and thousands just like me will be paying close attention to what happens in Harrisburg this session. We are organized, we are informed, and we vote. If you try to take swings at our rights, we will not forget. Rather than doing your best to attack and destroy the freedoms that we refuse to let you ever take away, what you should be doing is co-sponsoring Representative Borowicz's Second Amendment Preservation Act. This legislation passed into law in Missouri back in 2021, and it is the full embodiment of Article 1, Section 21 of the Constitution of Pennsylvania (the same one you swore to uphold and defend) that states, "The right of the citizens to bear arms in defense of themselves and the State shall not be questioned." Federal overreach on guns must be met with resistance by the Commonwealth of Pennsylvania. This state has a moral and legal obligation to protect its citizens from an out-of-control Federal government, and this bill will do just that. It's not only the right thing to do, but it is on safe legal ground, too, as the anti-commandeering doctrine that the bill uses has been upheld in several Supreme Court cases over the years.
