Please REJECT Trailer Bill Language for SB 2 & UPHOLD Police Accountability!
I am emailing you to demand that you prioritize public trust over secrecy by opposing the proposed Trailer Bill Language (TBL) that would weaken Senate Bill 2 (Bradford, 2021) around transparency of police misconduct!
SB 2 was passed by our policymakers and was signed into law by the Governor to ensure police who are bad actors are held accountable for misconduct and abuse of power. SB 2 created a pathway to decertify officers who engage in serious misconduct.
When activists, lawyers, law enforcement, and lawmakers negotiated SB 2, a critical provision was added stating all records introduced during decertification proceedings “shall be public.” This means that POST, the law enforcement agency responsible for conducting decertification proceedings, must respond to public records requests.
However, under the SB 2 TBL, POST can ignore all PRA requests for disclosable records in its custody connected to its certification and decertification duties, including records related to:
- physical abuse resulting in death or serious bodily injury (Pen Code 13510.8(b));
- sustained incidents of sexual assault against a member of the public (Pen Code 13510.8(b)
- demonstrated bias and other problematic moral character (Gov Code 1031); and
- criminal conviction data (Gov Code 1029(f)).
We, the people, will not accept secret dealings behind closed doors that prevent the public from accessing information and records about police misconduct, criminal acts, and abuse of power. The recent bombshell of rampant racist, sexist, and violent language in an Antioch Police Department group chat - where over HALF of the Department was implicated, has shown that we need to uphold SB 2 and not weaken it!
Police are not above the law, and the public deserves to know when they break their oath to protect and serve and cause harm to our communities. Please oppose the proposed SB 2 TBL and do not take the state backward with respect to law enforcement transparency!
