Music, literature, and the visual arts are pathways of expression that can not only define the essence of who we are as individuals, but also bring us together as a society. The impact of creativity on our culture has been recognized since the early days of our nation’s existence and the law has generally evolved accordingly to continue protecting and promoting the arts. However, our current copyright system is broken for thousands of members of the creative community who are unable to seek legal recourse after their work has been infringed upon. Litigation can be expensive and time-consuming, especially for artists and small businesses whose livelihoods depend entirely on their ability to create. The CASE Act would allow artists to settle copyright infringement disputes in the more cost-effective small claims court process.
