Her husband was murdered in a gun-free zone where the killer refused to abide by the gun ban. And now, she is speaking out against “red flag” gun grabs, pointing out how such law could have been used to disarm her in the days after her husband was murdered.
“I wasn’t suicidal. I was just going through a really hard time,” she said. “But someone very well-meaning -- a family member, a friend, a co-worker -- could say, ‘We’re really concerned about Nikki. This horrible thing has happened, we know she’s a gun owner,’ and then take their concerns to a judge.”
If a judge had ordered police to take away her firearm, deeming her a risk to herself or others, “for someone like me,” Nikki said, “that would have been trauma on top of trauma.”
“Here I’m scared to death, I’m already concerned for my safety, and then to go and take my basic human right of self-defense away from me with no due process?” she said. “It’s pretty scary.”

The jury’s now in: A couple different chapters of the American Civil Liberties Union agree that Gun Confiscation Orders (sugar-coated as “red-flag laws”) are unconstitutional.
And sadly, there are law-abiding Americans who have now found out the hard way that ignoring Due Process can be deadly. Take Gary Willis, who a 61-year-old, African-American gentleman living in Maryland. He was shot to death by police serving a “red flag” Gun Confiscation Order at 5:17 in the morning.
His crime? Well, he was a gun owner who answered his door in the middle of the night with a gun in his hand. And it turned out that an angry relative took out a Gun Confiscation Order to get back at him after an argument. And, as usual, the pliant judge didn’t really ask any questions.
And no one is going to be held accountable for his murder.
There aren’t many crimes for which you can be executed in America today. But apparently, you can be summarily executed without a trial for being a gun owner in a repressive “red flag” state.
Even those who survive the initial police raid still struggle to get Due Process. One study out of Florida found that 80% of “Red Flag” defendants are forced to fight for their innocence without attorneys. This is because these laws are a civil (not criminal) matter, so the accused are not given public defenders.
Well, who in our society is going to be most affected by the loss of Due Process and the right to an attorney? Will it not be the poor and disadvantaged? Those who believe late-night confrontations with police are more likely to produce fatal results for minorities might want to lay aside their hatred of guns -- and consider where the suspension of Due Process might lead.
