Red Flag laws are gun confiscation without Due Process
The so-called “gun control” bills you will shortly consider will not make us safer.
I am asking you to oppose the so-called “Red Flag” bill, HB 674 (Sullivan-D). Emergency Risk Protective Orders (ERPO’s) can precipitate violence and result in the “flagged” person being killed even before their weapons were confiscated or before they have their day in Court!
This actually happened in Maryland. Police knocked on the door of 61-year old Gary Willis of Ferndale, MD, who answered the door while armed at 5 AM, on November 5, 2018. Police came unannounced to tell Willis (a man they never met, at a home they never visited) that he was subject of an ERPO. They told Willis to turn over his guns. “Willis became increasingly agitated … when they mentioned he’d have to leave the home … he’d shared with his family for 20 years.” When Willis did not drop his gun, the police shot Willis who died at his home. Police were not found at fault.
Julian Castro, former 2020 democratic presidential candidate and Housing Secretary under President Obama, responded to a question on a related matter, posed by CNN’s Anderson Cooper: “In the places I grew up in, we weren’t exactly looking for another reason for cops to come banging on the door … I’m not gonna give … police … another reason to go door-to-door in certain communities … .”
The liberal Rhode Island ACLU in 2018 questioned an ERPO bill similar to HB 674: “The court order … could be issued without any indication that the person poses an imminent threat … without any evidence that the person ever committed, or has even threatened to commit, an act of violence with a firearm … police would have broad authority to search the person’s property. The standard for … issuing an order is so broad it could routinely be used against people who engage in ‘overblown political rhetoric’ on social media ….”
HB 421, (Price-D) supported by Governor Northam, lets local governments criminalize bringing any weapon, even one carried by a licensed Concealed Carry holder, into certain buildings or on the grounds of their jurisdiction.
Should these measures pass, defense of anyone’s life, in public buildings would be illegal if the locality deemed it so. Had Northam’s proposed policy been law in Texas, and a church service were held in a public school building, the Texas concealed carry hero who saved over 200 church members at the West Freeway Church of Christ on December 29, 2019, would be facing prison time. Why would you want to disarm Virginians who have passed rigorous background checks and have never committed a crime? I don’t see Governor Northam disarming his own bodyguards. Why the double standard?
Lastly, HB 9 (Bourne-D) requires that a lost or stolen gun must be reported within 24 hours of discovering the theft or face a $250 fine. It could also make persons whose guns are stolen, civilly liable for the crime the thief commits with the stolen gun if they failed to report the theft within 24 hours! “No person who, in good faith, reports a lost or stolen firearm shall be held criminally or civilly liable for any damages from acts or omissions resulting from the loss or theft.” Michael Bloomberg would be proud!
Please oppose all of these horrible bills and if you vote in favor, please explain why! It is not enough to use the excuse that “voters gave you a mandate.” Democrat candidates may have talked about “common sense gun safety” but none talked about draconian measures like the specific measures being proposed!

Under HB 674, law enforcement is charged with making an “independent investigation,” but the bill does not prevent a jilted romantic partner, a teenager angry at his or her parents, a pediatrician who worries his 10-yearold patient could be harmed by his father’s gun, a political rival, a stalker, or others from approaching the police to file an ERPO complaint.
Guns can be removed for up to 180 days at a time and be renewed after that. The “threat” of harm to self or others is speculative and need not even be imminent. HB 674 allows removal of guns by an Ex Parte court hearing where only one side is represented! This goes against our constitutionally guaranteed right to due process and a host of other rights!

Kate Nixon, beloved wife, mother of three young daughters, and Virginia Beach City employee, was one of 11 persons murdered by Virginia Beach employee. She wanted to bring her legal handgun to work because of concerns about this employee, but did not as she would have been fired!
Nixon family attorney, Kevin Martingayle, told radio host WHRV’s Cathy Lewis that: “Jason Nixon got a call from his wife at 4:06 PM saying, ‘I’ve been shot, please call 911.’ So, he immediately called 911, then he tried to reach her again, and couldn’t get her. And we learned later from the medical examiner’s report that what happened is she was subsequently at some point shot in the head. So, she was initially shot with a non-fatal wound, and we believe that was in the shoulder, and then later on, the gunman came back around, and shot her in the head and killed her.”
Do you agree with Gov. Northam’s intent to disarm concealed carry permit holders who pass stringent background checks beyond those required for a gun purchase? Does the Governor intend to disarm his bodyguards in the government buildings he occupies and visit? Isn’t it the height of hypocrisy to disarm certain law-abiding citizens who cannot afford to hire armed bodyguards?

Elites have the ability to hire heavily armed bodyguards for their protection. The state police guard Gov. Northam and state legislators like yourself during session, made possible by our tax dollars.
Red flag laws do not require ERPO’s orders for persons with symptoms of insanity or mental illness. Red flag laws remove guns without due process, on the recommendation of practically anyone, but the laws do not address the mental health problems that lead to suicide.
In fact, “… the experience in Connecticut and Indiana is that red flag laws have had no significant effect on either homicide or suicide because there was substitution between firearms and other methods or because there was no significant effect on either of these modalities. We also find that ERPO laws have had no significant effect on deaths or injuries from mass public shootings.” [Moody (William and Mary), and Lott, (Crime Prevention Research Center) “Do Red Flag Laws Save Lives?” 11/12/19]
HB 674 also ignores due process. Law professor David Kopel told the U.S. Senate Judiciary Committee in 2019 that: “an ex-parte system deprives individuals of five of the seven elements of due process: notice, opportunity [to] make an oral presentation, opportunity to present evidence, cross-examination and response to evidence, and the right to counsel. … even at a subsequent hearing, the Giffords/Bloomberg system continues to deprive the individual of due process, because the individual is not allowed to cross-examine adverse witnesses. … the adverse witnesses, including the accuser, never have to appear in court; they can submit affidavits instead.”

Law professor David Kopel told the U.S. Senate Judiciary Committee in 2019 that: “an ex-parte system deprives individuals of five of the seven elements of due process: notice, opportunity [to] make an oral presentation, opportunity to present evidence, cross-examination and response to evidence, and the right to counsel. … even at a subsequent hearing, the Giffords/Bloomberg system continues to deprive the individual of due process, because the individual is not allowed to cross-examine adverse witnesses. … the adverse witnesses, including the accuser, never have to appear in court; they can submit affidavits instead.”
HB 421 (Price-D) will authorize local governments to enact their own gun control laws, to make criminals out of concealed carry permit holders who bring guns into public buildings. Will the Governor disarm his bodyguards in the public buildings he works in and visits?
Kate Nixon, beloved wife, mother of three young daughters, and Virginia Beach City employee, was one of 11 persons murdered by a Virginia Beach employee. Nixon family attorney, Kevin Martingayle, said, “Kate expressed to her husband concerns about this individual in particular … they had a discussion the night before about whether or not she should take a pistol and hide it in her handbag — and decided not to, ultimately, because there’s a policy apparently against having any kind of weapons that are concealed in the building.”
HB 9 (Bourne-D) requires that a stolen gun must be reported to local or state police within 24 hours of noticing the theft. Failure to do so carries a $250 fine. Failure to report the stolen gun by the deadline could leave the owner of the stolen gun liable for the thief’s gun crimes.

Red Flag laws have failed, as suicides are increasing in ERPO states

Red Flag bills like HB 674 (Sullivan-D) are devised by people like Mayor Bloomberg who see no benefit to society from “average persons” owning guns. Elites have the ability to hire heavily armed bodyguards for their protection. The state police guard Gov. Northam and state legislators like yourself during session, made possible by our tax dollars.
Red flag laws do not require ERPO’s orders for persons with symptoms of insanity or mental illness. Red flag laws remove guns without due process, on the recommendation of practically anyone, but the laws do not address the mental health problems that lead to suicide.
In fact, “… the experience in Connecticut and Indiana is that red flag laws have had no significant effect on either homicide or suicide because there was substitution between firearms and other methods or because there was no significant effect on either of these modalities. We also find that ERPO laws have had no significant effect on deaths or injuries from mass public shootings.” [Moody (William and Mary), and Lott, (Crime Prevention Research Center) “Do Red Flag Laws Save Lives?” 11/12/19]
