Ask Governor Newsom to Veto AB2098

AB2098 would classify the dissemination or promotion of misinformation or disinformation related to the SARS-CoV-2 coronavirus, or “COVID-19,” as unprofessional conduct. The bill would require the board to consider specified factors prior to bringing a disciplinary action against a physician and surgeon. The bill would also make findings and declarations in this regard.

Talking Points:

  • Science is not black and white; it is gray and is built upon robust discourse with multiple points of view from qualified doctors to weigh all possible solutions.

Per CDC Rochelle W: “The implication was that science was black and white, and in fact, in an ever-evolving virus, and a two-year-long pandemic, the science isn't always black and white. It's-- it's often times shades of gray.”

  • COVID-19 PCR tests were not accurate for 2 years during the pandemic and have been revoked after Dec 31, 2021 due to its inaccuracy. Resulted in an inflated number of reported COVID-19 cases, hospitalizations and deaths, as this PCR test showed proof of multiple viruses, not just just COVID-19.

“CDC encourages laboratories to consider adoption of a multiplexed method that can facilitate detection and differentiation of SARS-CoV-2 and influenza viruses”

  • CDC data is not correct– nearly 2 years into the pandemic, Dr. Fauci admitted COVID-19 cases/hospitalizations and deaths were overcounted.

Dr. Fauci confirmed in Dec 2021 “But the other important thing is that if you look at the children who are hospitalized, many of them are hospitalized with Covid as opposed to because of Covid,” Fauci continued, emphasis added. “And what we mean by that — if a child goes in the hospital, they automatically get tested for Covid. And they get counted as a Covid-hospitalized individual. When in fact, they may go in for a broken leg or appendicitis or something like that. So, it’s over-counting the number of children who are, quote, ‘hospitalized with Covid,’ as opposed to because of Covid.”

  • Disinformation definition is “A form of propaganda involving the dissemination of false information with the deliberate intent to deceive or mislead”

“What is false today in science can be true tomorrow; and rational scientists and physicians can disagree vehemently with each other about many subjects.”

  • Science is based on the “scientific method”. Definition of “scientific method” is “A method of discovering knowledge about the natural world based in making falsifiable predictions (hypotheses), testing them empirically, & developing theories that match known data from repeatable physical experimentation.”

Science is an ever-changing way of learning about the natural world. How can a question, idea or thought qualify as misinformation?

  • Bill text from AB2098 “(e) Major news outlets have reported that some of the most dangerous propagators of inaccurate information regarding the COVID-19 vaccines are licensed health care professionals.”

Why is the major news qualified to identify what is inaccurate information regarding the COVID-19 vaccines? Are they medical health care professionals to know this?

Questions:

  •  The experts from the CDC who are leading our country in COVID policy did not get the science right. Why would you punish doctors across the country if they explored other options than the narrative?

If controlled studies have not been made regarding complexities of COVID, how can the state assume what statements, questions and facts are misinformation?

  • Would reporting an adverse reaction to VAERS be considered misinformation?
  • How is this enforced and regulated? How does this protect patient/doctor confidentiality?
  • Multiple treatment options are available for COVID-19. What medicine, vaccine or treatment is considered misinformation?

Main Talking Points:

Questions/Concerns:

  • Will I be discriminated against if I choose not to be vaccinated?
  • Will any jobs in my field be available to me if I am not vaccinated?
  • How will this bill ensure there is not discrimination?
  • Is the legislature considering the numerous barriers that the pandemic created for the hiring process and employment already?
  • California has already begun accepting COVID-19 as endemic and are getting back to life as normal. Why is the CA legislature considering approving a law that will force a medical injection to provide for their family?
  • If the COVID-19 vaccine does not prevent transmission to others or contracting the virus, how would a fully-vaccinated workforce keep people safer?
  • Largely populated cities and states such as New York, Seattle, Philadelphia, Washington D.C. and more have removed vaccine mandates due to the virus becoming endemic. If AB1993 passed, why would it be relevant by 2023?
  • The CDC states ‘natural immunity’ 6 times greater protection from COVID-19 than vaccination. Why is natural immunity not acceptable?
