WHO Treaty

The pending international treaty for pandemics WHO is working on is cause for concern. However, legally the President cannot enter into an international treaty without a two thirds majority vote of the Senate. (Article 2 of the Constitution) Moreover, "since the WHO agreement is NOT ratified by 2/3 of the Senate and it is NOT 'under the Authority of the United States' the 'States are NOT bound' to it. Therefore, the solution to this WHO agreement problem doesn’t begin with the US Congress, it begins with your State and local governments".  It is also important to note only Treaties (not agreements) that are made “under the Authority of the United States” (according to the terms of the Constitution) “bind” the States.  The WHO agreement does not rest “under the Authority of the United States,” therefore the States are not legally or Constitutionally required to follow it.**

Contact your Governor and State Legislatures.  They must convey to this Administration that any agreement signed by the President ending American Sovereignty will not be enforced by state leaders. 

Things to Consider:

  • The agreement on pandemic prevention, preparedness, and response adopted under the World Health Organization (WHO) would enable countries around the globe to strengthen national, regional, and global capacities and resilience to future pandemics.
  • Under the proposed amendments to the International Health Regulations, the WHO Director-General’s power and authority grows, including the power to move forward on a public health concern without authority of the State Party. WHO - Strengthening WHO Preparedness Proposal
  • What accountability will the WHO have as an unelected governing authority?
  • Will the treaty allow the WHO to become our governing body despite our Constitution?
  • Even if the treaty isn't signed, the CDC looks to the WHO for guidance. This is another reason why reaching out to our state legislators is so important. We need to make sure no unelected entity, such as the CDC and the WHO, have unchecked decision making authority over the American people.
